Reward terms

1. Types of Rewards
1.1. Each Group Administrator has the obligation to connect a Reward to their Private Group.

1.2. By adding a Reward to your Private Group, or publicizing, promoting or advertising a Reward on Upinion, you agree to this Reward Terms.

1.3. You can choose four different types of Reward: Upinonators receive a “thank you” message (“Love Reward”); Respondents collect Points they can redeem for a discount Voucher (“Discount Reward”); Respondents collect Points they can redeem for a free product Voucher (“Free Product Reward”); Respondents collect Points they can redeem for a Voucher to join a free prize draw (“Free Prize Draw Reward”).

2. Reward restrictions
2.1. Rewards must not:

  1. be open or marketed to individuals below the age of 18;
  2. be marketed with the aim of promoting regulated goods and services, such as tobacco, alcohol, gambling, pharmaceuticals, fireworks, weapons or health/medical devices;
  3. be illegal or breach public order or public morals;
  4. have an approximate retail value of more than €200.

2.2. Rewards may not include:

  1. regulated goods and services, such as tobacco, alcohol, gambling, pharmaceuticals, fireworks, weapons or health/medical devices;
  2. dairy, gasoline or pornography;
  3. cash prizes of more than €200;
  4. a condition requiring Respondents to provide sensitive personal information, including but not limited to bank details, social security number or driver’s license number.

3. Selecting a Reward
3.1. When you select a Reward on our Platform you can customize the details of your Reward, which is generated and displayed to you on our Platform.

3.2. When Respondents answer questions in Groups connected to a Discount Reward, Free Product Reward or Free Prize Draw Reward, they will receive points (“Points”). Respondents will receive one Point for each given answer. Love Rewards do not involve the collection of Points. Points do not represent any monetary value.

3.3. Points can be redeemed for vouchers (“Vouchers”) and are issued on behalf of the Group Administrator. Subsequently, the Group Administrator is the only one who can provide this Rewards to Respondents.

3.4. Unredeemed Points and uncollected Vouchers will expire if a Respondent is inactive for twelve (12) months.

3.5. Group Administrators are responsible for delivering their Rewards in accordance with the promises they made on our Platform. This means Group Administrators need to communicate clearly and fairly about their Rewards on our Platform, in Groups and, where applicable, through means of social media, email or other communication channels.

3.6. Group Administrators are responsible for ensuring that their Reward complies with all applicable (national) laws, regulations, industry rules and guidelines. Group Administrators acknowledge that compliance with this Reward Terms does not necessarily imply compliance with all applicable laws.

4. Promoting Rewards
4.1. Any publicity and information provided with the Reward must be true and accurate and must not mislead, deceive or otherwise misrepresent any aspect of the Reward.

4.2. You will not directly or indirectly indicate Upinion as a sponsor of the Reward.

5. Withdrawing a Reward
5.1. It is only possible to withdraw a Reward when:

  1. the Reward is a Love Reward;
  2. there are no Groups connected to the Reward;
  3. no Respondent has answered any questions yet.

5.2. Group Administrators are responsible for the Content and communication related to their Rewards and for any changes made to (the details of) their Rewards.

6. Free Prize Draw Rewards
6.1. You can carry out a Free Prize Draw using the feature on our Platform on a date selected by you. Our Free Prize Draw feature will randomly draw (a) winner(s) and supply you with a list of that/those winner(s).

6.2. Group Administrators must notify winners of Free Prize Draws with details of their winnings within a reasonable period of time, either via our Platform or via email. Respondents can see that they have a winning ticket on our Platform, but Group Administrators must also notify them directly.

6.3. Please note that a Free Prize Draw Reward may qualify as a (promotional) game of chance in certain countries and may therefore be subject to extra rules, regulations and conditions or even be forbidden.

7. Indemnification
7.1. You agree that Upinion acts only as an intermediary between you, as Group Administrator, and Respondents.

7.2. You will indemnify and hold us and our respective subsidiaries, affiliates, officers, directors, employees and agents harmless from and against all damages, losses, costs and expenses of any kind (including reasonable legal fees and costs) for any claim or cause of action related to your Rewards, including the publicity or administration of that Reward or use of any Data.

8. Intellectual property rights and privacy
8.1. You will not use our name, trademarks or any other of our intellectual property rights in association with a Reward without our express written consent.

8.2. You will handle any personal information of Respondents that you receive through the Platform in accordance with our Terms of Use, Privacy Policy and this Reward Terms.

9. Our Rights
9.1. We may remove any Content related to your Reward, or suspend or cancel your Reward or Account if we determine that you violate this Reward Terms, or if we consider that the continued marketing or administration of your Reward may be unlawful under applicable laws, regulations, industry rules or guidelines or may cause an unreasonable risk of liability for us.

9.2. We reserve the right to review your Reward at any time, but we are under no obligation to do so. Our failure to enforce any provision of this Reward Terms does not constitute a waiver of that provision.

9.3. This Reward Terms may be modified by us at any time without notice to you. You will be subject to the most current version of this Reward Terms if you continue to use our Services after any change becomes effective.

10.1. If you have a complaint about our Reward Terms, we encourage you to first contact us at [email protected] so we can discuss your concerns. We will try to resolve any disagreements that do arise between us quickly and efficiently.
